As for legal regulation of digital technologies, we cannot but mention the applied aspects of using unmanned aircraft (drones). Although the legislation in many countries, including Russia, incorporatesnormslimitingtheuseofdrones,protectionofprivacyremainsanissue.Inparticular,nocountry in the world provides landowners with adequate legal protection against the malicious actions of drone owners who may use drones to actually invade foreign land, photograph everyone without any permission, or otherwise interfere with their privacy (Holden, 2016).Theissueoftheinformation collected by the drones and the possibility of its use by the owners has not been addressed either
(Kaminski,2015).
Conclusion
Summarizing the findings of this study, it is important to emphasize that modern legislation is only beginning to establish rules for the use of digital technologies. On an international level, discussions currently focus on two possible strategies: to foster the digital economy development
(progressive advance strategy) or to minimize the risks related to its use (security strategy). On the state level, attempts are made to address the problem in a palliative manner through selective legal solutionsandtheadoptionofnationalprogrammesaimingatfindingcross-cuttingsolutions.
Whilenotdenyingtheimportanceofthiswork,thereistheneedforamorecoherentandsystematic approach to the development of digital law by addressing two fundamental issues: (1) Can traditional legal constructs be adapted to the digital economy, or are innovative laws needed? (2) How can a model for the universalization of transnational technologies law be designed?
The solution of the first issue directly depends on how modern jurisprudence will assess the legal identity of, and the ability to protect, digital technologies. The study showed that, in the light of digital development, the marginalization of traditional law is evident; therefore, the use of old structurescanonlyleadtomosaicregulationwithoutreservesforfurtherdevelopment.
The progressive development digital economy is undergoing is impossible without the development and adoption of fundamentally new legal structures with a long-term commitment. In particular, the legal identity of technologies, copyright and neighbouring law, machines liability, and insuranceneedtobefundamentallyreviewed.
It is also important to note that these models shall be developed at the level of the international communityratherthanonthelevelofindividualstates;thisensuresthelawsareuniversal.

Аннотация
Исторически реформирование налоговых систем всегда являлось ответомна преобразования в обществе, модернизирующие отношения государств, бизнеса и граждан. Новым современным вызовом стала цифроваятрансформация отношений в обществе, усиленная глобализацией, несмотря на снижениетемпов роста ее проявлений. Налоговая систематакже оказаласьвэпицентре произошедших, происходящихиожидаемых перемен. Считается, что глобализация и цифровые возможности снижают способность правительств собирать налоги, поэтомувновых условиях возникает потребностькак вреформировании налоговых систем, так ивоценкеикорректировкепринципов,обеспечивающихэффективностьихфункционирования.
Целью является исследование влияния цифровизации экономики и общества на справедливость налого обложения, включая критический анализ и обобщение реакции налоговых систем разных государств и корпораций на цифровые вызовы, связанные с налоговым обременением деятельности в рамкахбиз- нес-моделейввиртуальнойсреде.
Методологияисследования опираетсянабазовые положенияналогового законодательствавчастиопределения обязательных элементов налогообложения,атакже классические принципы налогообложения (справедливости, определенности, удобства для налогоплательщика, экономичности взимания), оригинальный авторскийподходкучетуформированиядоходовцифровыхкомпанийисверхдоходовцифровыхрантье.
В статье проведен анализ понятий «цифровое присутствие» и «рыночная юрисдикция» с учетом понимания юрисдикции на цифровых рынках, связанных непосредственно с деятельностью цифровых платформ, рассмотренывозможностииугрозыавтоматическогоплатежаналоговврамкахкаждойсделки,атакжеотдельныепроблемыопределенияфактапересеченияграницынематериальнымактивомилиоказываемойуслугой, котораяможетиметьвосновекакматериальныйактив,такицифровойсервис.Исследованиевлиянияцифровыхрешенийвбизнесеиевропейскогоподхода,ориентированногонаформированиепринциповсправедливого отнесения доходов к юрисдикции государств, в которых находятся потребители, позволило установить, что повышение налоговой определенности деятельности виртуальных компаний становится всебольшей необходимостью современного общества, несмотряна оппортунистическое поведение как отдельных компаний(относительнонациональныхправительств),такиправительств(относительномировогоэкономического пространства).Выделениеотсутствияпривязкикфизическомуприсутствиюналогоплательщикавконкретной юрисдикции для формирования прибыли компаний как налогооблагаемойбазы приводит к необходимости поискабалансамежду национальными налоговыми системамии появлением наднационального налогообложения,чтонесетрискидляобеспеченияпринципасправедливостивналоговойполитике.
Подтверждениетезиса о налоговой конкуренции государств и отдельныхтерриторий позволило сделать вывод о возможностях развития наднационального налогообложения в рамках совместного взаимодей-
