Продавец гарантирует:

а) что качество товара полностью соответствует условиям контракта; б) что поставленный товар

соответствует высшему уровню техники и высшим стандартам, существующим в

The Sellers quarantee:

a)that quality of the goods is in full conformity with the Contract conditions;

b)that the delivered goods correspond to the highest technical level and highest standards existing in the Sellers’ country for the goods

стране Продавца для данного рода товара в момент выполнения контракта; в) что при изготовлении товара были применены

высококачественные материалы и была обеспечена первоклассная обработка, сборка и техническое испытание; г) что комплектность пос-

тавляемого товара и технической документации полностью соответствует условиям контракта; Гарантийный период составляет ……. месяцев с даты ввода в эксплуатацию, но не более ……..

месяцев с даты поставки. Если в течение срока гарантии товар окажется дефектным или не будет соответствовать условиям контракта, Продавец обязан за свой счет по выбору Покупателя устранить дефекты или заменить дефектный товар новым, который должен быть поставлен без промедления на условиях, установленных Покупателем.

По требованию Продавца дефектный товар или части его после поставки нового товара или частей возвращаются Продавцу за его счет.

Если устранение дефектов производится по согласованию между сторонами силами Покупателя, Продавец обязан возместить ему связанные с этим расходы.

В случае устранения дефектов или замены некачественного товара или его части гарантийный срок продлевается на количество затраченного для этого времени. Если недостатки не могут

c)high quality materials, first-rate workmanship and high standard manufacture, assembly and technical test;

d)that the complete set of the delivered goods and technical documentation fully corresponds to that stipulated by the Contract.

The guarantee period is …….. months from the date of putting the goods into operation, but not more than ……… months from the date of delivery.

Should the goods prove to be defective during the period of guarantee, or not correspond to the conditions of the Contract, the Sellers for their own account are to undertake at the Buyers’ option either to remedy the defects or to replace the defective goods with new ones without any delay on terms stated by the Buyers.

At the request of the Sellers the faulty goods or parts of the goods are to be returned to the Sellers at their expense after delivery of the replaced ones.

If by mutual agreement between the Parties the elimination of defects is effected by the Buyers, the Sellers are to compensate the Buyers for all the expenses incurred by the Buyers in connection with this elimination.

In case the elimination of the defects or the replacement of faulty parts take place the quarantee period is to be prolonged for the period used for such elimination or replacement.

If neither party can eliminate the defects the Buyers have the right
